离婚率升高问题的婚姻法应对--婚外性与家庭分工视角

摘要

The cost of acquiring sex outside of marriage is gradually reduced , leading to a fading appeal of marriage as the means to satisfy sex life .The establishment of non-fault divorce principle and the lack of ef-ficiency in the divorce relief system result in a low sense of security in wedlock , while the marriage premium based on role division within the family is also on the decline .The marriage law should respond positively to the rising divorce rate by strengthening the control of sex outside of marriage , so as to prevent the frequent“divorce-remarry” cycle and guarantee the expected returns on marriage.%婚外性的获取成本逐渐降低导致婚姻作为获取性满足手段的吸引力愈来愈小。无过错离婚原则的确立及离婚救济制度缺乏效率导致婚姻预期缺乏保障，基于家庭内部分工形成的婚姻溢酬逐渐消失。婚姻法应对离婚率升高作出积极回应，加强对婚外性行为的控制，防止频繁的“离婚－再婚”循环，保障当事人对婚姻的预期收益。
