论美国同性婚姻案宪法解释及其方法

The interpretation itself and the methods of interpretation on the Fourteenth Amendment put forward by the Supreme Court of the United States apparently presents a tit -for -tat confrontation and separation pattern.The proposals, opinions and positions exist no commensurability about whether or not same -sex marriage rights are constitutional .The case of Obergefell obviously shows the profound influ -ence of politics in constitutional interpretation .%美国最高法院对宪法第14条修正案关于“任何州未经法律正当程序，皆不得剥夺任何人的生命、自由或财产”的正当程序条款所作的解释以及采用的解释方法，显然呈现一种针锋相对的对峙与分离格局；关于同性结婚权是否合乎宪法的主张、观点、立场均存在不可通约性，在欧伯格菲案中，人们明显地感受到政治对于宪法解释的深刻影响。
