国际投资仲裁独立专家规则研究

摘要

In international investment arbitration, the tribunals appoint expert to assist it to find the truth on expertise frequently. Through the practice, it develops rules of independent expert in international investment arbitration gradually, which relate to the subjects on qualification and independence of the expert, the discretion of tribunal in appointing experts, hearings of experts, and valuation of expert evidence. China lawyers should be familiar with the rules of independent expert in international investment arbitration, which can be also used for reference in Chinese international commercial arbitration.%在国际投资仲裁中，仲裁庭常常指定专家协助查明涉及专门性问题的事实。国际投资仲裁实践逐渐发展出独立专家规则，涉及专家的资质和独立性、仲裁庭指定专家的自由裁量权、专家报告的准备与提交、独立专家出庭作证以及专家证据的审查认定。我国仲裁实务人士应当熟悉国际投资仲裁中的独立专家规则，同时国际投资仲裁中独立专家规则对于我国国际商事仲裁的相关实践亦有借鉴价值。
