第三人利益合同相关理论探讨

Contract for the benefit of third party is one of many exceptions to the principle of relativity of contract system. Compared to Contract for the benefit of third party with the common contract has its own characteristics, of which a third party based on the benefit of a third party contract made directly to independent claims as its main feature. Depth study of the theory of Contract for the benefit of third party, to provide a theoretical basis for the future construction of related systems in China.%第三人利益合同是合同相对性原则的众多例外制度之一。与普通合同相比，第三人利益合同有其自己的特点，其中第三人基于第三人利益合同而取得直接独立的请求权为其主要特征。深入研究第三人利益合同的相关理论，为我国未来构建相关制度提供理论依据。
