合同诈骗罪与民事欺诈行为的认定

从合同诈骗罪与民事欺诈行为的概念及特征来看，二者有很多相似之处，都表现为行为人的主观心理是故意，都是以虚构事实或隐瞒真相的方法欺骗他人，但二者之间又有着本质的区别。全面考察行为人的目的和行为特征，是判断该行为是刑事诈骗还是民事欺诈的决定性因素。%There are many similarities in the concept and characteristics of contract fraud and civil fraud ,such as the performance of the perpetrator ’ s intentional subjective psychology ,and cheating others by means of fabricating facts or concealing the truth .But there are essential differences between them .A comprehensive study of the perpetrator ’ purpose and behavior characteristics is a decisive factor to judge whether his act is criminal fraud or civil fraud .
