The legal effect of violating the mandatory provisions of contract of laws and administrative regulations has been an important research topic in recent years. The effectiveness of the contract directly influences the security and stability of the transaction. Different people , how- ever, hold different views in the cognizance of the legal effect of violating mandatory provisions of contract, resulting in the disaccord with the judgment standard in judicial practice. By analyzing and comparing the foreign legislative cases and combining with our legislation reform of invalid contract and the judiciary＇ s processing way of the legal effect of violating the mandatory previsions of contract as well as reflecting and making a research on it, we can maintain the security and stability of the transaction, promoting orderly the development of Chinese economy.%违反法律、行政法规强制性规定合同之效力一直是近年来学者们研究的一个重要课题，合同的效力直接影响到交易的安全和稳定性。然而在违反强制性规定合同效力的认定上，不同的人有不同的观点，造成司法实践中判断标准的不统一。因此，通过对国外立法例进行分析和比较，结合我国合同无效的立法变革及目前司法机关对违反强制性规定合同效力处理方式，对我国违反强制性规定合同的效力进行思考和研究，有利于维护交易的安全和稳定，促进经济健康有序的发展。
