拒不支付劳动报酬罪中的“劳动报酬”解读

         

摘要

《刑法修正案(八)》增设了拒不支付劳动报酬罪,使欠薪的入罪讨论暂告一段落,当前探讨的主要问题转为该罪的司法适用问题。从基本范围上看,“劳动报酬”只包括基于劳动关系产生的报酬,而不能包含基于劳务关系产生的报酬。“劳动报酬”包括工资,但也不仅仅限于工资范畴。社保个人缴费及经济补偿金也应属于该罪名的保护范畴,但惩罚性款项不属于该罪名的保护范围。%The eighth Criminal Law Amendment added the crim e of refusing to pay rem uneration.
