The judgment centralism is an important measurement that the Communist Party of China is determined to comprehensively promote the course of running state affairs according to law in 18 at the Fourth Plenary Session. The judgment centralism not only corrects the mistake of former criminal investigation but also reconstructs the relationships of the right (power) and obligation among prosecutor, defendant and trial, which would take a profound influence on the construction, mode and effects of criminal investigation. The criminal investigation organ must transform its conception of investigation to deal with the impact caused by the reform of the construction of lawsuit. Thus, the investigation organ not only should keep a modest open mind, but also the collecting of evidence should insist on the criteria of court's judgment.%"以审判为中心"是党的十八届四中全会决定全面推进依法治国的一项重要举措."以审判为中心"是对从前以侦查为中心的刑事诉讼的一种纠偏,是对控辩审三方权力(利)义务关系的重新构造.该理念的树立必定会带来侦查构造、侦查效果、侦查模式上的深刻变革.作为在刑事诉讼中具有基础地位的侦查机关,应当及时转变观念,以应对诉讼结构变化对传统工作模式带来的冲击,因此侦查机关对侦查权的运用应当保持谦抑,并且适度开放,对证据的收集核实亦应当坚持以裁判为标准.
