论婚姻关系中“第三者”的侵权行为——兼议无过错方的法律救济途径

The ＂third party＂ is the person,who knows the other party has a spouse but still establishes the improper relationship with the man or the woman,and therefore destroys other′s normal order of marriage and family,has the infringement conduct to seven rights such as spouse right,reputation right,property ownership and so on from the innocent party.So,the innocent party in the marriage is the real victims under the ambiguous legislative background of the current ＂Marriage Law＂ and relevant judicial interpretations on the third phenomenon.We need to strengthen the relief function of tort law,and the foundation is to establish a scientific and perfect system of tort damages to the ＂third party＂ as soon as possible.%＂第三者＂是指明知对方有配偶依然与其建立不正当的男女关系,从而破坏他人正常的婚姻家庭秩序的人。其实施侵权行为具体侵犯了无过错方的配偶权、名誉权、财产所有权等7种权利。婚姻关系中的无过错方是切实的受害者。在《婚姻法》以及相关司法解释对＂第三者＂现象没有明确规定的背景下,我们一方面需要强化侵权法的救济功能,但最根本的还是要尽快建立科学完善的＂第三者＂侵权损害赔偿制度。
