论权力运用与法治中国的若干关系--从“APEC 蓝”现象入手的分析

During the 2014 APEC conference in Beijing,the high air quality status of Beijing and the measures which the government has taken can be called APEC blue phenomenon.In fact,the government uses the state power to take un-conventional measures under the state of emergency for a period of time in order to show a good national image to the world.However,the exercise of state power existing in APEC blue phenomenon is restriction and derogation to the freedom and liberty of citizens,challenges to the authority of the Constitution and the law,and also is deviating to the rule of law,thinking by rule of law,administrative by law.%在2014年北京 APEC 会议期间，北京的空气环境质量状况以及政府为达致这一状况而采取的措施，可称为“APEC 蓝”现象。其实质是政府为向世人展示一个良好的“国家形象”，运用国家权力，在一段时间内采取类似紧急状态下的非常规措施，而达致其所追求目标的国家行为。然而，在以“APEC 蓝”为代表的类似现象中，国家权力的运用在许多方面也对公民权利和自由形成了一定程度的克减与限制，引起了我们对宪法和法律威权的思考，也引起了我们对权力运用与法治原则、法治国家、法治思维、法治行政等若干关系问题的思考。
