行政调查程序中相对人协助义务探析

相对人协助义务因理论基础和现实需要构成其正当化的依据，在具体类型上分为作为义务与容忍、服从义务。相对人协助义务的合理配置，核心在于行政机关的行政调查职能与相对人权利保障之间的平衡，包括相对人应具备协助之行为能力、明示制度、采取最小的损害之手段、拒绝履行协助义务的法律后果。%The theory basis and the reality need constitute the basis of justification of the assistance obligation of the relative person. The specific types are divided into action obligations and tolerance and obedience obligations. The core of the reasonable configuration of the assistance obligation lies in the balance between the functions of administrative investigation of the administrative organ and rela-tive rights,including the assist ability the relative person shall have,the express system,the means that may bring the smallest damage, and the legal consequences that the relative person refuses to fulfill his assist obligation.
