中国传统法律文化中的孝对当世的启迪∗

The filial piety embodies the spirit of humanitarianism in Chinese traditional legal culture and has met the needs of China's ancient traditional social and political domination, but it has both positive and negative sides. Under the aging background today, in the process of building a modern nation ruled by law, it is necessary to continue giving full play to the essence of Chinese traditional legal culture. While remembering the good factors, we should also sum up the evil factors and enable the nation to play its positive roles, better protect the seniors’ le-gal rights and interests, and to keep a healthy and orderly development of social order.%中国传统法律文化中的孝体现了人道主义精神，适应了中国古代传统社会政治统治的需要。但传统法律文化中的孝既有其积极的一面，也有其消极的一面。在当今老龄化的背景下，在建设现代法治国家的进程中，要继续发挥中国传统法律文化中的精华，记住善的因素，同时也要总结恶的因素，使国家发挥应有的积极作用，以更好的保障老年人的合法权益，使社会秩序健康有序发展。
