清水江文书是林农进行林业经营的一种制度性保证,其功能之一体现为对林地使用权的维护,以确保当地林业经营的稳定运行. 为稳定林农对宜林地的使用权,核心问题就是要明确界定林界. 清水江文书所体现的制度性设定完全植根于当地的习惯法当中. 研究发现,习惯法精神规定的基本原则在林业契约四至表述中,都有明确的反映和相应的证据,可以证明习惯法是通过赋定使用权的方式去平息争议,维护使用权的稳定,确保林业经营的可持续运行.%The Qingshuijiang Document is an institutional guarantee for forest farmers to conduct forestry trade . One of its functions is to maintain the right of forest land use so as to ensure the stable operation of the lo-cal forestry management. To stabilize the forestry farmers' rights for suitable land use, the core issue is to clearly define the forest boundary. The institutional setting of the practice embodied in the Qingshuijiang Documents is entirely based on the local customary law. The study has found that the basic principles established on the cus-tomary law in the Forestry Contract (4) are clearly stated with corresponding evidences to clarify that customary law is to quell the dispute by means of specifying the given rights for use, to maintain the stability of the right for land use, and to ensure the operation of sustainable forestry management.
