多模态视阈下庭审话语中的法律事实建构

摘要

It is a difficult job to identify a legal fact in judicial practice, which could benefit from the perspective of multi-modal discourse analysis. This paper offers, first, a literature review of multimodal discourse analysis, defining such key terms as objective fact, fact of a case and legal fact. Then it analyzes three major stages of a court trial discourse, which embody the representational, the interactional and the compositional meaning respectively. On this basis it discusses the representation of case facts, co-construction of evidential facts and identification of legal facts. Last, it points out some urgent research topics.%法律事实的认定是司法实践中的一个难题。多模态话语理论为法律事实的认定，提供了重要的理论视角。首先综述了多模态话语研究，对客观事实、案件事实、法律事实等概念进行界定；然后分析指出庭审中的调查、辩论和宣判等三个阶段分别具有再现、互动和组成等三种多模态话语意义，进而讨论了庭审话语中基于案件事实呈现、证据事实共建和法律事实认定的法律事实建构；最后指出亟需开展的研究课题。
