物业服务费请求权是一种新型权利,目前对其的司法救济是以适用简易程序为主,适用普通程序为辅。物业服务费请求权案件属于基本无法律争议的纠纷类型,因此在实践中,法院适用简易程序及普通程序等争讼程序对其审理有失便利、快捷。虽然小额诉讼程序能够满足物业服务费请求权案件的审判要求,但其缺乏独自的程序性规定,无法真正发挥作用。鉴于此,以修改后的督促程序审理物业服务费请求权案件恰如其分。%The claim of property services fee is a new right, and its judicial relief at present is mainly based on the summary procedure but supplemented by the ordinary one. Basically, there are no any legal disputes existed in the cases regarding claim of property service fee, thus it is not convenient and efficient for the court to apply litiga-tion procedure to hear them. Although small claim procedure could meet the requirements of such cases, it cannot really work because of the lack of separate procedure. In view of this, it is better to apply the revised supervising procedure for these cases.
