基于欧盟追续权指令的我国追续权制度构建

摘要

The promotion and maintenance of the artwork market’s economic vitality depend on the artists’ cre‐ative work .The resale right system ,which is carefully designed through the EU Resale Right Directive ,pro‐vides an effective mechanism for encouraging creativity of artists and enhancing competitiveness of the artwork market .The paper attempts to examine the rationality ,operability and economic impact of the directive based on studies of the resale right theory and related practices ,and seeks to find out a better approach to construct the resale right system for China .The result shows that the system can help to inspire artists with creative en‐thusiasm ,redress the balance between the economic situations of artists and sellers ,and promote the sustain‐able development of the artwork market .However ,the system can provide all mechanism effects only if it is a‐ble to ,on the basis of clarifying the resale right’s attributes ,accurately define subject and application scope of the resale right ,and scientifically determine the royalty calculation method and management scheme .%艺术品市场经济活力的提升和保持依赖于艺术家的努力创作，欧盟《追续权指令》精心构建的追续权制度为促进艺术家的创作和增强艺术品市场的竞争力提供了有效机制。文章基于追续权理论和相关实践的研究深入分析该指令的合理性、操作性及对艺术品市场的经济影响，进而探讨我国追续权制度的构建方法。研究结果表明，追续权制度能够激发艺术家的创作热情，矫正艺术家与销售商间的利益失衡，并促进艺术品市场的持续发展。该制度若要充分发挥机制作用，应在明确追续权权利属性的基础上准确界定追续权主体及适用范围，并科学制定权利金计算方法和管理方案。
