大学生隐私权的法律救济和保护

摘要

Privacy protection is out of respect for freedom and human dignity .However ,owing to the absence of relevant institutional system ,the weak consciousness of the rule of law and the inadequate legislation in the country ,invasion of students'privacy is not uncommon in colleges and universities w hen it comes to dormitory management ,information handling and disciplinary punishment .How to balance between students'right to privacy and the school's administrative power and its right to infor‐mation is a pressing issue to address in building a harmonious campus .Legislation should be strength‐ened .Relevant rules and regulations must be modified and improved .More importantly ,the adminis‐trators must change their old ideas and raise their ability and skill to manage by law and safeguard students'privacy .%隐私保护是对自由和人性尊严的尊重，但由于高校管理制度的欠缺、法治意识的淡漠和我国立法的不足，高校在宿舍管理、信息使用、违纪处理中侵犯大学生隐私权的现象时有发生。如何平衡大学生隐私权和高校管理权、知情权的冲突，是建设和谐校园的重要课题。应当通过加强立法，完善相关的规章制度，转变高校管理人员的观念，提高依法管理的水平和能力，真正以生为本切实维护大学生的隐私权等合法权益。
