审查起诉阶段非法证据排除的实践困境与制度构想

摘要

The stage of review and prosecution of exclusion of illegal evidence is necessary,but the difficulty of finding and verification regarding illegal evidence leads to the obstruction of the stage of review and prosecution of illegal evidence exclusion in practice.To get rid of the dilemma,it needs to build and perfect a system on the stage of review and prosecution of illegal evidence exclusion,such as involving procuratorial organs in the investigation procedure to guide evidence,improving the supervision of the procuratorial work,constructing hearing procedures,establishing information disclosure mechanism.%审查起诉阶段排除非法证据很有必要，但非法证据发现难、调查核实难等现实因素导致审查起诉阶段的非法证据排除在实践中遭到了冷遇。为摆脱这一困境，应当对审查起诉阶段的非法证据排除加以制度性构建和完善，包括让检察机关介入侦查程序引导取证，完善监督、检察工作机制，构建听证程序，建立信息公开机制等。
