民事检察监督制度研究

摘要

民事检察监督制度是民事审判程序中重要的监督制约制度，但司法实践中暴露了不少问题，其中立法上的缺陷是制约民事检察制度发挥作用的主要因素。如何通过立法完善民事检察监督制度以适应社会主义法治国家建设、服务社会主义经济发展、营造和谐的民事交易环境是当前民事检察监督的重要工作。%The system of civil procuratorial supervision is an important supervising and restricting system in the civil judicial procedure. But a lot of problems appeared in the judicatory practice, in which the defect of legislation is the main factors of restricting the civil procuratorial system playing a role. It is one of the important works of the civil procuratorial supervision, that is, how to pass the legislation perfection of civil procuratorial supervision system in order to adapt to the socialist law construction, serve the socialist economic development and build harmonious civil transaction environment.
