校园人身侵权民事责任归责原则的选择与适用

In many problems of the campus infringement of the person, the School of Civil Responsibility principle is a fun- damental problem. Complexity of the cause of the infringement occurred, it is difficult to establish a single imputation prin- ciples to resolve civil liability for school commitment, application of the principle of fault liability should be based on the campus personal tort causes and circumstances of the case, the principle of presumption of fault responsibility, supplementary liability principle be identified to the school with attribution of responsibility and cases in a timely manner to resolve.%在校园人身侵权的诸多问题中,学校民事责任的归责原则是根本性问题。由于侵权发生原因的复杂性,难以确立一种单一归责原则来解决学校民事责任的承担问题,应根据校园人身侵权发生的原因和案件具体情况适用过错责任原则、过错推定责任原则、补充责任原则等加以认定,以期学校责任的归属和案件的及时解决。
