食品安全刑法保护制度的特点分析

摘要

In recent years , food safety crackdown criminal incidents are increased in China, but food safety is still frequent criminal incidents, how to effectively control the occurrence of food safety crimes, it has become a social event our government and the people most concerned about. Chinese food safety system is based on the protection of the criminal law"Criminal Law"as the core of law enforcement, legal protection system in order to"Food Safety Law"for the supplementary system. But with the development of society, the characteristics of Chi-nese food safety system of criminal law to protect more and more obvious. This paper will analyze the advantages and disadvantages of food safety criminal law protection system analysis"Criminal Law"and"Food Safety Law"the intrinsic link proposed for the current situation of food safety criminal law protection measures for improve-ment of food safety offenses full blow, maintain health, economic development and social stability of the people of our country.%近年来我国对食品安全违法犯罪事件打击力度加大，但食品安全违法犯罪事件仍然频繁，如何有效的控制食品安全违法犯罪的发生，已经成为我国政府和人们最为关注的社会事件。我国的食品安全刑法保护制度是以《刑法》为执法核心，以《食品安全法》为补充的法律保护体系制度。但是随着社会的发展，我国食品安全刑法保护制度的特点越来越明显。通过分析我国食品安全刑法保护制度的优势和缺点，分析《刑法》和《食品安全法》的内在联系，提出针对目前我国食品安全刑法保护制度现状的改进措施，对食品安全犯罪行为进行全面打击，维持我国人民健康、经济发展和社会的稳定。
