浅析大部制改革下保健食品的安全监管及法律使用

摘要

在我国食品药品监管"大部制"改革的情况下，面对新的《保健食品监督管理条例》尚未出台之际，为保障保健食品的安全，避免出现监管漏洞，监管部门应更加做好保健食品安全监管工作。本文就监管过程中一些保健食品违法事实由于法规不明确难于处理等问题，如何运用现有法律法规做出适当的处罚，做了较为详细的阐述。%Under the reform of food and drug institutions in our country, the health food supervision and management regulations has not yet come. In order to ensure the security of the health food , avoid regulatory loopholes, we should do a good job to guarantee the health food safety. According to the regulatory experience of health food, the bas was made with detailed elaboration on how to use the existing laws and regulations to make the appropriate punishment of the health food illegal behaviors.
