我国消防技术标准溯及力分析

摘要

为了厘清消防技术标准适用问题,从遵循科技进步的规律、提高全社会安全水平的角度,通过分析消防技术标准与法律规范的概念及本质属性,研究了我国消防技术标准溯及力问题在现实中存在的困境,提出消防技术标准应当溯及既往,同时辅之以性能化规范的主张.结果表明,以现行消防技术标准衡量火灾隐患的严重程度,以消防性能化防火技术决定整改的方案,以消防法律对不整改火灾隐患构成的违法行为处以强制力的惩罚,三者各司其职,分工合作,在各自领域内保证社会消防安全水平,能解决目前消防技术标准适用问题.%In order to clarify the applicability of fire safety standards,from the perspectives of following the scientific progress law and improving social fire safety level and by analyzing the concept and essential attribute of fire safety standards and laws,the plight of China's fire safety standards retroactive effect was studied,and suggestion of fire safety standard being retrospective,accompanied by performance based design was made.Results showed that,using existing fire safety standard to judge the severity of fire hazard,using performance based design to decide the rectification program,and using fire law to mandatorily punish the illegal activities of not correcting fire hazard,each of these 3 means perform its own functions,and work in cooperation,can ensure the fire safety collectively,and solve the applicability problem of fire safety standard.
