美国药品知识产权保护最大化策略研究

摘要

获得最大化的知识产权保护是每一个权利人最关心的问题.文中首先分析了美国药品知识产权保护的构成,再从3个角度详细研究了美国药品知识产权保护最大化的策略,即基于专利保护的最大化策略、基于数据独占性保护的最大化策略和其他策略,并分析了这几种保护策略的异同和适用范围,为我国制药商获得药品知识产权保护最大化提供了参考和借鉴.%How to gain the maximum of intellectual property protection is the topic for pharmaceutical manufacturers most concerned about. In this paper, we analyzed the composition of the protection of pharmaceutical intellectual property in the U.S., and then comprehensively researched the strategies for maximizing drug intellectual , property in the U. S. , I. E. Patent-based strategies, food and drug law-based strategies and other strategies. We also analyzed the similarities, differences, and scope of these types of protection strategies. These strategies provide references for the pharmaceutical manufacturers in China.
