海上承运人对货物责任保险利益有关问题研究——兼论对《中华人民共和国海商法》第44条规定的修改

分析探讨因对海上承运人承运货物责任保险利益的不同理解所引发的承保、适用保险条款、隐名保险等问题，澄清《中华人民共和国海商法》第44条“保险利益”规定引起的歧义，提出对第44条规定的修改意见。%This article discussed such issue as the marine carrier＇s insurable interest of the cargo liability, underwriting of carrier＇s cargo liability, application of relevant insurance clauses, undisclosed insurance etc., clarified the disputes arising from the meaning of ＂benefit of insurance＂ provided for in Article 44 of the Maritime Code of the People＇s Republic of China and suggesting for the revision of Article 44 was given afterwards.
