水库移民征地补偿协商机制构建研究--基于合意治理的思考

摘要

The purpose of the paper is to reflect and ameliorate the decision-making mechanism of land expropriation compensation for reservoir resettlement. Methods employed are the combination of empirical and normative analysis. The result indicates that the system of land expropriation compensation for reservoir resettlement, which was formed during the planning-oriented economy era, presents partial dimensional feature. This kind of decision-making mechanism couldn’t provide the basis of consensus on land expropriation compensation for reservoir resettlement. Furthermore, it is easily resulted in conflicts. It is concluded that we should establish a new negotiation system of land expropriation compensation for reservoir resettlement in order to solve the contradictions in the context of consultative administration. The prerequisite should follow the so-called principle of resettlement the first and project the second. The basis is the formal procedural rules on the public participation and the information transparency. The supporting condition is to return rights and formal registration. And lastly its implementation should supplemented by a formal channel for complaints and appeals.%　　研究目的：反思和重构中国水库移民征地补偿决策机制。研究方法：基于水库移民征地补偿问题的实证分析，运用规范分析方法对水库移民征地补偿合意困境及协商机制的构建进行深入探究。研究结果：孕育于计划经济时代的中国水库移民征地补偿制度呈现出单向度的特征，这种制度设计致使水库移民征地补偿法律关系双方缺乏合意的基础，也成为矛盾和冲突频发的诱因。研究结论：消解水库移民征地补偿矛盾，应根据协商性行政兴起的理论背景，构建以协商议价为基础的水库移民征地补偿决策机制。该机制设计的先决程序是“先移民、后工程”，基础为建立参与和公开的正当程序规则，支撑条件为确权赋能，后续程序为畅通的申诉保障。
