城中村改造利益分配中的法律问题研究

摘要

城中村的改造应合理平衡政府、村民和开发商之间的利益关系。由于村民决策权、社会力量监督权缺失等原因，一些城市的利益分配失衡问题比较突出，其典型表现为失地贫民阶层和寄生食利阶层现象对社会公平价值的拷问。立法要以实体正义理论为指导，厘清各方的应然利益；同时也要注重程序规则的设计，规范利益分配的过程。%The reform of urban village should balance the interests of government,villagers and real estate company. Because of the lack of right for villagers and the public,the imbalance in benefit allocation is a serious problem in some cities. Its typical characteristic is the landless poor class and rentier class ,which damages the fair value of society. The legislature should take the guidance of the theory of substantive jus⁃tice,in order to distinguish reasonable interest of the three parties. At the same time,the legislature should design rules of procedure,in order to regulate the process of benefit allocation.
