About the Conditions Required by the Law in Order for the Surviving Spouse to be Allowed to Inherit

The article analyzes the conditions that have to be accomplished in order for the surviving spouse to inherit the deceased spouse. After a brief introduction in which there are presented the aspects referring to the regulation of the status of legal heir of the surviving spouse and the rights that the law recognizes for him there are examined the general conditions of the right of inheritance to be met by the surviving spouse, respectively to have the capacity to inherit, to have the inheritance vocation and not to be unworthy to inherit and also the special condition which targets the status of spouse. In the final part there are highlighted the conditions that can be drawn from this study.
