Jud and Janet Walton ("the Waltons") own the surface estate of a forty-acre tract inside the city limits of Midland, Texas ("the City")- Endeavor Energy Resources, L.P., ("Endeavor) owns an oil and gas lease that includes the Walton's tract. Endeavor applies for a permit to drill a well on the Waltons' tract and the City Council votes to deny the application. Following the filing of a suit by Endeavor challenging the City's decision, Endeavor and the City reach a settlement agreement, and as part of their agreement, the City grants the previously denied drilling permit application.
