Lanisha Walker, on behalf of An toine L. Crawford Jr., sued Harriett Management Inc. (BMI), Janice Fein-berg and Charlotte Himmel in the Cuyahoga County Court of Common Pleas, alleging injury from lead poisoning. Walker alleged that the defendants negligently failed to inspect the premises for lead, failed to take steps to protect Crawford from harm and failed to warn the family. The defendants contended that Walker failed to supervise her child and that such negligence was the cause of any injury, if in fact there was an injury. BMI appealed the trial court's ruling in favor of Walker, arguing that the evidence was insufficient to support the judgment and that the verdict contravened the manifest weight of the evidence.
