Louisiana mineral servitudes are extinguished by prescription resulting from nonuse for 10 years. La. Rev. Stat. § 31:27(1). However, prescription may be interrupted by "good faith operations for the discovery and production of minerals." La. Rev. Stat. § 31:29. In Neumin Production Co. v. Tiger Bend, Ltd., No. CA 10-1307,2011 WL 815944 (La. Ct. App. Mar. 9,2011), the court of appeal affirmed the lower court's ruling that a mineral servitude had prescribed for 10 years' nonuse.
