Oil Products Shipper Questions Buckeye’s and Affiliate’s Rates and Impact on Services to Three New Jersey-New York Airports

Motiva Enterprises LLC has challenged a rate filing submitted on May 27 by Buckeye Linden Pipe Line Co. LLC (IS14-399), claiming it is substantially in excess of the rates previously charged by Buckeye Linden and its predecessor for the same movement, and, therefore, has not been shown to be just and reasonable within the meaning of the Interstate Commerce Act (ICA). Motiva requests that the Commission (1) require Buckeye Linden to file the requisite “cost, revenue, and throughput data supporting such rate and (2) condition the effectiveness of the proposed rate subject to full refund following the outcome of a formal evidentiary hearing.
