Food Loss and Waste in the European Union: A New Challenge for the Food Law?

Much has been written about the urgent need to reduce food loss and waste , although little has actually been done about it. Indeed, it is too complex a topic to be dealt with thoroughly in one article, and so I have chosen to concentrate here on past, current and potential European Union (EU) initiatives in this area, which I will summarise after first outlining the nature of the problem at stake. The purpose of this article is to identify new or modified Food Law provisions (including soft law measures and self-regulation mechanisms) that could help to alleviate food loss and waste. Nevertheless, 1 should forewarn the reader that as the subject matter is relatively new (at least to me), the conclusions are less than comprehensive, limited to a series of avenues to explore and possible solutions worth examining from a legal perspective, even if their short-term effect is limited or insufficient. If, having analysed what (little?) has really been done to resolve the problem at hand3,1 have managedat least to provoke questions and discussions among colleagues specialising in food legislation both inside and outside the EU, then this article will in large part have fulfilled its purpose.
