Engineers have laboured under the delusion that the Act is only for subcontractors. While it is true that an engineer's contract for design services is not construction work and not therefore covered by the Act, any engineer acting on behalf of the principal is affected. The principal is now more exposed to the actions (or inaction) of the person charged with responsibility for certifying payments and making decisions under the contract.
