EPA Introduces Proposed Rule Improving Transparency of Guidance Documents

Near the end of May, following the requirements of President Trump's Executive order "Promoting the Rule of Law Through Improved Agency Guidance Documents," the EPA published a NPRM in the Federal Register creating consistent procedures and requirements for how the agency will manage the issuance of guidance documents. The Trump administration has stated the proposed rule will enhance the agency's process for managing guidance documents and considerably increase the transparency of EPA's practices around guidance.
