Although two justices issued strongly worded dissenting opinions, the West Virginia Supreme Court of Appeals has set aside a 50 million dollars verdict against Massey Energy and in favor of Harman Mining and its owner, Hugh Caperton, in a decade-old dispute. Massey said that interest charges added to the award while the case was on appeal had increased Massey's total potential liability to 76 million dollars. The company praised the verdict.
