US appeals court reverses CIT decision on OCTG from China

The US Court of Appeals for the Federal Circuit has reversed a decision by the US Court of International Trade regarding US antidumping and countervailing duty orders on oil country tubular goods, according to a court opinion recently made public. The appeal involves the Department of Commerce's scope inquiry regarding the AD and CVD orders covering OCTG from China issued in 2010. In the 2014 scope ruling, Commerce determined that green (unfinished) tubes produced in China and subject to heat treatments in third countries were still covered under the scope of the AD and CVD orders as they determined the heat-treating process did not qualify as a substantial transformation.
