In 1938, Congress passed the Fair Labor Standards Act (FSLA), establishing a minimum wage and a forty-hour workweek as the legal basis for overtime. While the concepts of overtime and minimum wage seem simple, the FLSA is one of the most complex labor laws there is. Indeed, even with the most competent of human resource professionals, nearly every company, no matter how sophisticated and careful, is violating the Fair Labor Standards Act in some way. I would also guess that many employers are unaware (and therefore not complying with) certain local wage and hour requirements imposed by the states in which they operate.
