The federal Fair Labor Standards Act (FLSA), passed in 1938, requires employers who fall within its reach to comply with several different "fair labor standards." One of the FLSA's most significant provisions is the requirement to pay workers one and one-half times their regular wage for hours worked above the customary "workweek" of 40 hours. This general requirement for overtime pay has many exemptions, many of which have been the subject of constant litigation. Nearly every employer in the country must comply with the FLSA's overtime provisions. Assuming your company is subject to the FLSA, you must determine which of your employees are entitled to overtime (nonexempt employees) and which are not (exempt employees), and ensure that you have compensated the former for their overtime work.
