To the Understanding of the Statutory Order Empowerment Pursuant to Article 12 German Transfusion Law (Transfusionsgesetz; TFG) and to Guideline Competence Pursuant to Article 12a TFG

The statutory order pursuant to article 12 German TFG and the guidelines of the German Medical Association (Bundesarztekammer; BAK) and the Paul Ehrlich Institute (PEI) pursuant to article 12a TFG are independent legal or regularization instruments that are complementary to each other. The statutory order defines binding legislation that must be observed by physicians and other medical personnel. In addition functional guidelines can be compiled and announced which provide more detailed standards as operational guidelines that are not mandatory from a legal point of view. They complement the binding regulations of laws and statutory orders and can be viewed as coherent system of rules in form of recommendations. They must not be contrary to binding regulations in law and statutory order.
