The Challenge of Principled Gap-Filling: A Study of Implied Terms in a Comparative Context

There has been a veritable wealth of literature on implied terms-ranging from doctoral theses to book chapters, articles and (more recently) a book. What accounts for this interest? Perhaps the simplest explanation is that it is an extremely important topic with at least two important functions-one substantive, the other theoretical. As it has turned out, its continued success has (unsurprisingly, for reasons that will be apparent in a moment) been with respect to the former rather than the latter.
