CONSOL Energy can continue Fola Operations after judge changes mind

The judge blinked. CONSOL Energy received notice that Judge Robert C. Chambers, of the United States District Court for the Southern District of West Virginia, Huntington Division, has ruled that the company's Fola Operations near Bick-more, WV, can continue to operate past the judge's previously imposed deadline of January 23, 2010. Judge Chambers December 28 granted CONSOL subsidiary Fola Coal's motion for judicial relief of his previous ruling of November 24 that found deficiencies in the permit notification process by the U.S. Army Corp of Engineers, which resulted in the setting aside of a previously approved permit for Fola that had been issued in January 2008. At that same time, Judge Chambers stayed his November 24 ruling for 60 days - until January 23, 2010 - to give Fola an opportunity to appeal or seek other relief.
