Judge allows Consol's Fola to continue mining

Consol Energy subsidiary Fola Coal can continue operations near Bickmore, W.Va., even as the Army Corps of Engineers reevaluates Fola's surface mining permit, a West Virginia judge told the company yesterday. Judge Robert Chambers of the US District Court for the Southern District of West Virginia granted Fola the ability to continue its surface mining operations, despite ruling on Nov. 24 that the Corps had erred in granting Fola's permit. The court granted Fola's motion asking to continue operations in the six valley fills where surface mining was already occurring under previously court-issued approvals.
