Korean Patent Court Decision Highlights Double Patenting Rules

摘要

A divisional patent that encompasses the scope of its parent patent is substantially identical to the parent and is invalid because of double patenting, the Korean Patent Court held, as the patents are based on a same technical idea and the constitutive differences between the two patents do not produce any new effect.
