A windfall tax of €250 million on Belgium's nuclear generators was passed into law in late December. The tax applies to 2008. A spokesman for Electrabel has confirmed to Platts that it will comply with the law and pay the tax, for which its liability is around 90% of the total (with SPE liable to pay the remainder). The amount is paid directly to the government by Synatom, which manages the nuclear decommissioning reserves, but is reclaimed from the generators from Synatom. However, the spokesman said Electrabel plans to challenge the legality of the tax in the Constitutional Court. The Belgian government plans to levy a further €500 million in 2009.
