Publication Of Reach Authorization List Triggers Legal Requirements For Companies

The European Chemicals Agency Oct. 28 published a list of 15 substances that have been nominated for banning or restriction under the European Union's REACH legislation, triggering certain legal obligations for companies dealing in the substances. In particular, companies manufacturing or importing the listed substances into the European Union must now provide safety data sheets to their customers or be in breach of REACH, which stands for the registration, evaluation, and authorization of chemicals. Geert Dancet, head of the European Chemicals Agency (ECHA) said it is "critical" that companies understand that formal publication of the list of substances "generates immediate new legal obligations for the communication in the supply chain." Suppliers of preparations and of products containing the listed substances are also obliged to provide information to their customers when the substances are present above certain weights.
