German supermarket chain Aldi lost its trademark opposition claim against small cafe business Bon Appetit, based in Cheltenham, Gloucestershire. Rejecting the retailer's suit that Bon Appetit's logo causes consumer confusion with its own 'Bon Appetit!' brand, the UK's IP Tribunal held in November that the bon appetit phrase was too generic to receive protection and dismissed the opposition because the actual logos differed. The Gloucestershire-based restaurant, which has five other locations in the South West and sells all food items for 99p, prevailed against the German brand that has 9,000 stores in 18 countries, after the tribunal held the cafe's name formed in heavy, plain, black lettering on an orange background with the figure 99 in the 'O' was not similar to Aldi's two UK registered trademarks.
