HUD guidance on implementation of the 2003 regulation on participation of faith-based organizations in programs operated by the Office of Community Planning and Development (CPD) notes potential statutory and regulatory conflicts concerning employment discrimination. Notice CPD 04-10, issued September 29, says a faith-based organization doesn't forfeit its exemption from the prohibition on employment discrimination on the basis of religion when it receives HUD funding. The exemption is provided in Section 702(a) of the Civil Rights Act of 1964. "However," the notice adds, "a faith-based organization, like any other entity participating in a HUD funded program, must comply with all the statutory requirements of that program."
