A state housing finance agency's liability for failure to automatically adjust Section 8 contract rents annually depends on the language of the housing assistance payments (HAP) contract, the U.S. District Court for the Northern District of Illinois, Eastern Division, ruled, finding no liability where the contract required the owner to request rent increases.
