EPA RELEASES NEW TIMELINE FOR BOILER MACT STANDARDS

The Environmental Protection Agency announced late this week a new timeline for consideration of its revised Maximum Achievable Control Technology standards for boilers and incinerators (Boiler MACT). The EPA said it will propose its reworked standards, which limit emissions from mercury and dozens of toxic air pollutants found in soot, by the end of October 2011 and issue the final rulemaking in April 2012. An initial draft version of the rules had been released in April 2010, and the EPA received more than 4,800 comments on the proposal. After petitioning the D.C. Circuit Court of Appeals for more time to sift through the public comments and recalibrate the rules, the Court ruled in January that EPA had to release its final rules in February. The EPA did so, but issued a stay on the effective date of the rules last month, saying that it wanted more time for the public to review the standards.
